The Position

Superior Court of California, San Mateo County is seeking highly qualified individuals to fill one vacancy for a Court Commissioner. The appointment to this position shall be by the judges of the superior court and shall be under the general direction of the presiding judge.

Pursuant to California Rules of Court, candidates must have been admitted to practice law in California for at least 10 years or, on a finding of good cause by the presiding judge, for at least 5 years.

The commissioner’s duties include the subordinate judicial duties set forth in Code of Civil Procedure Section 259 which include but are not limited to conducting judicial hearings in a broad range of civil proceedings which may include family law, making findings of fact in traffic, small claims, and criminal proceedings and performing other subordinate judicial activities as may be conferred by law or by order of the court. • Experience as a hearing officer, judge pro-tem, or mediator.

Description

The Bay Area Air Quality Management District is recruiting for the position of Assistant Counsel I/II in the Office of General Counsel. This position will focus primarily on civil prosecution of air quality violations, including cases seeking civil penalties and/or injunctive relief before the Air District’s administrative Hearing Board and in Superior Court. Experience prosecuting or defending such cases under air quality or other environmental laws, or in other similar enforcement contexts, is highly desirable. The position will also provide legal advice, counseling and representation on related legal issues arising under local, state and federal air pollution laws and regulations, including air quality permitting, development of new regulations, California Environmental Quality Act issues, contract drafting, administrative law issues, and civil rights compliance, among others. Many of the most pressing air quality issues the Bay Area faces relate to disproportionate air pollution burdens in historically disadvantaged communities, so experience and familiarity with environmental justice issues is desirable. This is a full-time, exempt, management position. The Bay Area Air Quality Management District is the government agency responsible for protecting air quality in the San Francisco Bay Area. Under direction, the position performs legal work of a routine to complex nature representing the Air District, provides advice and counsel to Air District management and staff, represents the Air District in court and administrative proceedings, and performs related work as assigned.
 
Distinguishing Characteristics:
 
Assistant Counsel I is the entry level in this specialized attorney series. It is designed to allow an experienced civil attorney to gain specific environmental law experience. This class is alternately staffed with Assistant Counsel II, and incumbents may advance to the higher level after gaining experience and demonstrating proficiency that meet the qualifications of the higher level class.
 
Assistant Counsel II is the journey level class of this specialized series, fully competent to perform a wide range of environmental law work. This class is responsible for providing effective legal counsel in complex and controversial environmental law matters. This class is distinguished from Senior Assistant Counsel in that the latter assists in administering and coordinating all phases of legal work for the Legal Division.

Examples of Duties for this Position

Prepares and tries routine to difficult cases, often involving a specialized body of law.

Represents the Air District in court and in administrative hearings before boards and commissions and state and federal agencies.

Investigates and prepares reports regarding claims by and against the Air District and recommends actions to be taken.

Advises Air District departmental management regarding Air District authority, jurisdiction, functions and operational procedures.

Researches legal problems and prepares opinions, briefs, ordinances, resolutions, and other legal documents.

Attends Air District departmental, board and commission meetings to provide legal advice on a variety of matters.

Reviews ordinances, resolutions, contracts and other documents for legal sufficiency; recommends modifications as required.

Minimum Qualifications

Education and Experience:
 
Assistant Counsel I: Equivalent to graduation from a college or university plus an appropriate law degree and two years of experience as an attorney engaged in the practice of law, preferably with a public agency and preferably involving environmental law and/or enforcement cases, although other relevant experience will be considered.
 
Assistant Counsel II: In addition to the above, two additional years of experience as an attorney engaged in the practice of law, preferably practicing civil environmental enforcement with a public agency in the State of California, although other relevant experience will be considered.
 
 Other Requirements:
 
 Must be a member in good standing of the State Bar of California at the time of hire.

Possible Substitutions:
• Administrative or supervisory experience in a public safety department may be substituted for the dispatching experience on a year for year basis.

LICENSE
Possession of a valid California Class C driver's license is required at time of appointment and for duration of employment.

SPECIAL CONDITIONS
• Willing to respond to callback in case of major emergencies or local disasters;
• Willing to work Saturdays and odd, irregular and unusual hours;

As a Public Safety Dispatcher II, this non-sworn classification dispatches public safety, fire, and emergency medical services out into the community. This classification is distinguished from the Public Safety Dispatcher I by a broader range of responsibility due to a higher level of experience and training.

This class is distinguished from the class of Public Safety Dispatcher I in that the latter is the entry level class where incumbents are trained on full range of dispatch functions under immediate supervision. This class is distinguished from the Senior Public Safety Dispatcher in that the latter has full responsibility for supervising a shift of Public Safety Dispatchers I/II.

 

 

Typical Duties

 

Each position in this classification may not include all the duties listed below, nor do the examples cover all the duties that may be performed.

• Operates base radio console equipment, transmitting and receiving routine and emergency messages
• Receives emergency and routine requests for services from the public via 9-1-1, alternate emergency lines, and business lines
• Dispatches appropriate emergency vehicles, equipment and personnel in response to those requests, in accordance with established policies and procedures
• Coordinates emergency operations between various departmental personnel and equipment
• Operates data terminals for information pertaining to daily public safety operations, and general emergency services
• Maintains written logs, files, and computer information in the prescribed manner

Minimum Qualifications

 

EDUCATION AND EXPERIENCE

• Graduation from high school or possession of a GED; and

DESIRABLE QUALIFICATIONS

• Classroom education involving fire science or law enforcement related studies.

LICENSES/CERTIFICATES

• Possession of a valid California POST Public Safety Dispatcher Basic Certificate and a valid Medical Priorities Dispatching System (MPDS) Certificate are required prior to the completion of the probationary period.

OTHER REQUIREMENTS

Must be able to perform all the essential functions of the job assignment. All candidates will be required to pass a City background investigation, which will include fingerprinting and may include polygraph and/or psychological testing.

PERMANENT CITY EMPLOYEES PREFERENCE POINTS
Current permanent employee candidates who receive a passing score on the examination will have an additional five (5) points added to his/her final score.

Under general supervision, operates, maintains, troubleshoots, and repairs a wide variety of pumping, heating, ventilating, air conditioning, refrigeration and auxiliary plant machinery and equipment in a large complex or multi-faceted facility. Ensures that all equipment, machinery and systems are functioning normally and safely, and complies with all applicable safety rules and regulations. The incumbent will either be assigned to work in the world class historic Cable Car Barn or the Mechanical Systems Program which manages SFMTA’s subway system, this includes the recently completed Central Subway extension project.

*Different shifts at the Mechanical Systems Program (MSP), various Subway Stations, and Cable Car (CC) Building, at 1201 Mason Street, San Francisco, CA 94108. Initial trainings may occur in shifts different than those listed below:

1. Transit CC (Grave, SUN-THU, 21:00-05:00 / 9:00pm-5:00am)
2. Transit CC (Grave, THU-MON, 21:00-05:00 / 9:00pm-5:00am)
3. Transit MSP (Grave, MON-FRI, 22:00-06:00 / 10:00pm-6:00am)
4. Transit CC (Day, FRI-TUE, 09:00-17:00 / 9:00am-5:00pm)
5. Transit MSP (Grave, SAT-WED, 22:00-06:00 / 10:00pm-6:00am)

Essential functions of the class include:

• Operates, maintains and repairs a wide variety of pumping, heating, ventilating, air conditioning, refrigeration, and power generating equipment in a large complex or multi-faceted facility to ensure the safe, correct and efficient functioning of the facility and equipment may be required to operate computerized building management systems, preventative or predictive maintenance computer systems or Computerized Data Gathering System (SCADA).
• Inspects and tests: machinery and equipment for safe, efficient and proper operation by visual and audio inspection during walk-throughs and by standard monitoring; fire prevention equipment to ensure safe and proper functionality; water storage and multiple distribution systems, high pressure zones, wood and steel storage tanks, pumps and relief valves, and samples of water.
• Makes entries and keeps records on shift operation by taking and entering gauge readings and accurate water laboratory analysis readings and temperatures on operating log sheets or into a computer data system to ensure preventative maintenance and equipment history; and changes charts and recordings accordingly.
• Receives, records and stores large amounts of treatment chemicals and may handle hazardous chemicals in confined or enclosed areas; must be capable of safely and properly handling chemical spills; may also include handling and treatment of industrial or hazardous waste.
• Contacts, communicates and is required to deal with contractors, building tenants and/or the general public in order to be able to discharge assigned duties.
• Maintains keys, communications equipment, and security (in the absence of Security Personnel), in order to ensure the security of a plant and buildings and grounds, including public safety. As part of an emergency response team, recognizes, evaluates, and responds to potentially hazardous situations.
• Performs control tests on water samples to determine chlorine and fluoride residual, pH, alkalinity, turbidity, color, saturation index and flocculation factors; under supervision, conducts water analysis and regulates treatment chemical dosages to maintain water quality in filtration plant, distribution system, or other large complex facility may also be required to perform water analysis on water/wastewater as required by the State of California; performs boiler water and cooling tower chemical tests, including pH, alkalinity TDS, etc., to monitor and control growth of organisms in water.
• Performs related duties as required.

Nature of work
Involves physical effort in the repair and maintenance of machinery and equipment; the ability to lift heavy objects; exposure to working conditions where minor abrasions, bruises, and burns may occur; occasional uncomfortable work inside closed and dirty spaces; exposure to potential uncomfortable weather conditions and traffic conditions; and requires physical stamina to stand, stoop, bend and climb ladders while working in confined spaces, entryways and tight crawl spaces.  Some positions may also require the ability to operate both automatic and manual automobile transmission as needed. Employees may be required to work rotating shifts, nights, weekends, and holidays, and a shift of up to 12 hours.

MINIMUM QUALIFICATIONS:

1. Four (4) years of verified journey-level stationary engineer experience in the maintenance, repair and operation of a variety of mechanical and electrical pumping, heating, air conditioning, ventilating and related plant machinery used in a government establishment, hospital, industrial, production or commercial building; AND

2. Possession of a valid California Driver’s License; AND

3. Possession at time of hire a Universal Chlorofluorocarbon (CFC) certificate issued by the Federal Environmental Protection Agency.

Substitution: (Any of the following may be substituted for the required experience)

• Completion of a recognized four-year Stationary Engineer apprenticeship program
• Graduation from a recognized four-year Maritime Academy with a degree in engineering or technology
• Possession of at least a 3rd Assistant Marine Engineer's License of any (unrestricted) horsepower

SELECTION PROCEDURE:

The San Francisco Municipal Transportation Agency (SFMTA) has determined that Class 7334 Stationary Engineer is a “safety-sensitive” position, under regulations issued by the Federal Transit Administration (49 CFR Part 655). Federal law requires that all transit employees who perform safety-sensitive functions be subject to random, post-accident, reasonable suspicion, return-to-duty and follow-up drug and alcohol testing. All applicants for Safety-Sensitive positions shall undergo urine drug testing prior to employment and within 90 days prior to performing Safety-Sensitive functions for the first time. Receipt by the SFMTA of a negative test result is required prior to the employee being placed on the payroll. A positive, adulterated, negative dilute or substituted test will result in a decision not to hire, and the applicant’s name will be removed from the list of eligibles for Safety-Sensitive positions. The SFMTA will not consider hiring any person who tested positive, adulterated, substituted or refused to submit to testing for a minimum of two years following the positive test.

In addition, each applicant who has worked for a Department of Transportation (DOT)-regulated employer(s) within the last two years will be required to sign a consent form, prior to appointment, authorizing SFMTA to obtain information from his/her prior employers concerning his/her drug and alcohol test history.
