The Position

Superior Court of California, San Mateo County is seeking highly qualified individuals to fill one vacancy for a Court Commissioner. The appointment to this position shall be by the judges of the superior court and shall be under the general direction of the presiding judge.

Pursuant to California Rules of Court, candidates must have been admitted to practice law in California for at least 10 years or, on a finding of good cause by the presiding judge, for at least 5 years.

The commissioner’s duties include the subordinate judicial duties set forth in Code of Civil Procedure Section 259 which include but are not limited to conducting judicial hearings in a broad range of civil proceedings which may include family law, making findings of fact in traffic, small claims, and criminal proceedings and performing other subordinate judicial activities as may be conferred by law or by order of the court. The commissioner will be expected to perform duties in all of the following areas: criminal law, family law, traffic, small claims, and a broad range of civil proceedings.

The Ideal Candidate will have:

• Experience as a hearing officer, judge pro-tem, or mediator.
• Experience with trial and hearing procedures and with the rules of evidence.
• Knowledge of court calendars.
• Demonstrated ability to present statements of law, fact and argument clearly and logically in written and oral form.
• Ability to manage a courtroom in a fair, courteous and efficient manner so as to promote respect for the judicial process.
• Ability to establish and maintain effective relationships with judicial officers, attorneys, court staff and various governmental agencies.
• Experience working effectively with the public, especially in stressful situations.
• Ability to work efficiently and with flexibility.
• Experience working in and with the citizenry of San Mateo County.
• Experience with the following court calendars: criminal (including arraignments and pretrial calendars), family (including child support and domestic violence restraining orders), traffic, small claims, and civil (including unlawful detainers).

The Parks, Recreation and Neighborhood Services Department is currently seeking to fill two temporary (Overstrength) full-time Community Activity Specialist vacancy in the BeautifySJ Prorgram. The position is currently funded through June 30, 2026. These two (2) Community Activity Specialist who will support the Encampment Management Team with the implementation of the no return/no encampment zone for encampments. In addition to this assignment, these two positions will assist the encampment abatement teams with weekly abatement activities including noticing encampments, referrals to partner departments for outreach, providing education on encampment setback areas. The position daily engagement with those residing in homeless encampments. Those selected for the positions can expect to work in-person, 40 hours per week with a typical in-person schedule of Monday-Friday.

Description

The Bay Area Air Quality Management District is recruiting for the position of Assistant Counsel I/II in the Office of General Counsel. This position will focus primarily on civil prosecution of air quality violations, including cases seeking civil penalties and/or injunctive relief before the Air District’s administrative Hearing Board and in Superior Court. Experience prosecuting or defending such cases under air quality or other environmental laws, or in other similar enforcement contexts, is highly desirable. The position will also provide legal advice, counseling and representation on related legal issues arising under local, state and federal air pollution laws and regulations, including air quality permitting, development of new regulations, California Environmental Quality Act issues, contract drafting, administrative law issues, and civil rights compliance, among others. Many of the most pressing air quality issues the Bay Area faces relate to disproportionate air pollution burdens in historically disadvantaged communities, so experience and familiarity with environmental justice issues is desirable. This is a full-time, exempt, management position. The Bay Area Air Quality Management District is the government agency responsible for protecting air quality in the San Francisco Bay Area. Under direction, the position performs legal work of a routine to complex nature representing the Air District, provides advice and counsel to Air District management and staff, represents the Air District in court and administrative proceedings, and performs related work as assigned.
 
Distinguishing Characteristics:
 
Assistant Counsel I is the entry level in this specialized attorney series. It is designed to allow an experienced civil attorney to gain specific environmental law experience. This class is alternately staffed with Assistant Counsel II, and incumbents may advance to the higher level after gaining experience and demonstrating proficiency that meet the qualifications of the higher level class.
 
Assistant Counsel II is the journey level class of this specialized series, fully competent to perform a wide range of environmental law work. This class is responsible for providing effective legal counsel in complex and controversial environmental law matters. This class is distinguished from Senior Assistant Counsel in that the latter assists in administering and coordinating all phases of legal work for the Legal Division.

Examples of Duties for this Position

Prepares and tries routine to difficult cases, often involving a specialized body of law.

Represents the Air District in court and in administrative hearings before boards and commissions and state and federal agencies.

Education and Experience:
 
Assistant Counsel I: Equivalent to graduation from a college or university plus an appropriate law degree and two years of experience as an attorney engaged in the practice of law, preferably with a public agency and preferably involving environmental law and/or enforcement cases, although other relevant experience will be considered.
 
Assistant Counsel II: In addition to the above, two additional years of experience as an attorney engaged in the practice of law, preferably practicing civil environmental enforcement with a public agency in the State of California, although other relevant experience will be considered.

 Must be a member in good standing of the State Bar of California at the time of hire.

REPRESENTATIVE DUTIES

1. Conducts pre-operational inspection of the transit vehicle, in accordance with federal and state laws and departmental regulations, to ensure it is functioning properly.
2. Inspects the passenger compartment of the vehicle to ensure it is free from hazards (such as spills, loose handrails and stanchions, defective seats, etc.) and that the video camera lenses are not obscured.
3. Safely navigates the vehicle through traffic along assigned routes, under various environmental conditions, in accordance with traffic laws and departmental regulations.

2.  Possession of a valid High School Diploma, GED or California High School Proficiency Certificate AND
3.  One (1) year of verifiable satisfactory public contact or customer service experience AND
4.  Possession of a valid class C Driver License. Must have been a licensed driver for at least three (3) continuous years from April 30, 2021 through April 30, 2024 AND
5.  Possession of or the ability to obtain a Class B - Driver License with a Passenger (P) Endorsement and no restrictions that prohibit operation of a San Francisco Municipal Transportation Agency public transit vehicle AND
6.  A good driving record during the three (3) years between April 30, 2021 through April 30, 2024 and through the date of appointment, meeting the following requirements: 

• No more than 1 moving violations between April 30, 2023 and April 30, 2024;
• No more than 3 moving violations between April 30, 2021 through April 30, 2024;
• No accidents where applicant contributed to cause; 
• Has not had driving privilege suspended, revoked, or placed on probation more than once for a cause involving the unsafe operation of a motor vehicle; 
• No convictions of California State Vehicle Code Section 20001 (leaving the scene of an accident involving bodily injury or death); Sections 23103 through 23109 (reckless driving); or Sections 23152 - 23153 (driving under the influence of alcohol or drugs), or equivalent convictions in another state;
• Other violations and/or accidents will be reviewed on a case-by-case basis and may be cause for non-selection AND

7.  No convictions within the past seven (7) years between April 30, 2017 through April 30, 2024 of any offense related to the use, sale, possession, or transportation of narcotics, habit forming drugs, or dangerous drugs AND
8.  No convictions of any sex offense as defined in Section 44010 of the Education Code AND
9.  Ability to obtain a School Pupil Activity Bus (SPAB) certificate issued by DMV.

Selection Process: (General Exam Process Information)

Minimum Qualification Supplemental Questionnaire (MQSQ): Candidates will be required to complete a MQSQ as part of the employment application. Eligible List/Score Report: A confidential eligible list of applicant names that have passed the civil service examination process will be created and used for certification purposes only. Medical Examination/Drug Testing: Candidates who are being considered for appointment may be required to pass a medical examination. The San Francisco Municipal Transportation Agency (SFMTA) has determined that Class 9163 Transit Operator is a “safety-sensitive” position, under regulations issued by the Federal Transit Administration (49 CFR Part 655). Federal law requires that all transit employees who perform safety-sensitive functions be subject to random, post-accident, reasonable suspicion, return-to-duty and follow-up drug and alcohol testing. All applicants for Safety-Sensitive positions shall undergo urine drug testing prior to employment and within 90 days prior to performing Safety-Sensitive functions for the first time. Receipt by the SFMTA of a negative test result is required prior to the employee being placed on the payroll. A positive, adulterated, negative dilute or substituted test will result in a decision not to hire, and the applicant’s name will be removed from the list of eligibles for Safety-Sensitive positions. The SFMTA will not consider hiring any person who tested positive, adulterated, substituted or refused to submit to testing for a minimum of two years following the positive test.

In addition, each applicant who has worked for a Department of Transportation (DOT) – regulated employer(s) within the last two years will be required to sign a consent form, prior to appointment, authorizing SFMTA to obtain information from their prior employers concerning their drug and alcohol test history. Each applicant will also be required to provide SFMTA with information regarding whether, during the last two years, the applicant tested positive or refused to test on any pre-employment drug or alcohol test administered by an employer to which the applicant applied for, but did not obtain, safety-sensitive transportation work covered by DOT drug and alcohol testing rules. SFMTA will not hire any applicant for a safety-sensitive position who fails to provide this information or fails to provide written consent for the release of information from prior employers. 

Class B Permit with Passenger (P) endorsement and Airbrakes: 
Applicants who are successful in the examination process and who do not possess a Class B Driver License with Passenger (P) endorsement and airbrakes, will be required to obtain a Class B Driver Permit with Passenger (P) endorsement and airbrakes prior to starting the Transit Operator training.

Transit Operator Training:
All employees must successfully complete the SFMTA Operator Training Program consisting of both classroom and behind-the-wheel instruction. The rate of pay for a trainee is $31.0375 per hour.

Attendance to all training sessions is required. If a candidate misses any dates of training without providing proper notification, they will be released from their training class. If proper notification was provided, a candidate released during the training period due to attendance may request to be placed back on the eligible list to be considered for future classes, if the list from which they were hired is still active. Candidates may only request to be placed back on the eligible list one time.  Any candidate not approved to be placed back on the list or not able to be placed in another training class before the list expires will need to re-apply during the next filing period for applications.
