THE JOB

At the helm of the City’s legal leadership is a part-time elected City Attorney, Rob Epstein, who has served for seventeen years as San Rafael’s City Attorney with dedication and expertise. An elected City Attorney is fairly rare (a total of 10 statewide) and the part-time position is even more unique. For many years, this distinctive structure has delivered an effective combination of elected political leadership with professional legal support for the City. In this model, the elected City Attorney sits as a trusted counterpart to the elected City Council, providing both legal advice and political leadership.

In addition to the elected part-time City Attorney, the City’s legal office is comprised of two full-time attorneys and one legal assistant. The legal team has been known for its collegial, respectful, and inclusive environment. The City Attorney’s Office also oversees and collaborates with various outside legal counsel, focusing on areas such as land development, human resources, tort litigation, and labor negotiations. 

Due to the part-time nature of the position, the elected City Attorney does not manage or oversee the daily operations of the City’s legal affairs. Instead, this responsibility falls to a strong Chief Assistant/Assistant City Attorney, who provides operational leadership and management. While the elected City Attorney offers high-level legal oversight and representation, the Chief Assistant/Assistant City Attorney and support staff handle the bulk of the legal work, ensuring the City’s legal needs are met efficiently and effectively. The Deputy City Attorney will also work with departments to draft and review contracts, agreements, and other legal documents for daily operations, provide legal support and guidance on PRAs, and conducts legal research and prepares reports or memoranda, and make recommendations to the elected City Attorney. This structure balances the benefits of elected accountability and experience with the necessity of onsite professional legal expertise in managing the City’s legal affairs.

Deputy City Attorney I/II

This classification is part of the Mid-Management employee group, a team of highly qualified and dedicated individuals who work under general direction and supervision of their department Directors. Essential responsibilities include but are not limited to:

• Consults with and provides legal advice to staff in various departments of the Cit. It is anticipated that that a key role of the new attorney will be to consult and support Human Resources with Labor Relations, Discipline, Investigations, ADA, and EEO issues, while also representing and consulting with other client departments.
• Reviews staff reports and advises staff on complex and controversial legal matters.
• Drafts and reviews ordinances, resolutions, contracts, deeds, leases and other legal documents and instruments.
• Represents the City at various City Council, commission and community meetings.
• Performs legal research and prepares opinions on various legal issues for City departments.
• Represents the City in civil and some criminal matters in both state and federal court and in administrative proceedings.
• Represents the City in arbitration hearings.

Assistant City Attorney and Chief Assistant City Attorney
Both classifications are executive management positions under the general direction and supervision of the part-time elected City Attorney. There is a high level of direct communication, coordination, and collaboration with the City Manager and two Assistant City Managers. Both classifications would be part of the City’s executive leadership team and support the City Manager’s Office directly.

Assistant City Attorney

Executive & Operational Management

The Assistant City Attorney focuses on delivering and overseeing the City’s legal services and providing direct legal support to City departments and City staff. 

Both the Chief Assistant City Attorney and City Attorney perform all of the traditional legal duties found in municipal legal operations such as, but not limited to:

• Ability to act as Acting City Attorney when part-time elected City Attorney is not available.
• Perform legal research; review and apply laws, rules, cases and ordinances; and prepare opinions on various legal issues.
• Proactively identify legal risks and develop strategies to reduce and manage those risks.
• Coordinate and supervise the work of outside counsel engaged by the City for special legal issues and litigation matters.
• Negotiate and draft and/or approve contract forms, complex contracts, deeds, leases and other legal documents and instruments.
• Prepare complex and routine opinions; advise City Council and staff regarding proposed courses of action and City policy.
• Represent the City at various City Council, board, and commissions meetings and in court as assigned, and render legal advice on agenda items.
• Represent the City in civil and some criminal matters in both state and federal courts and in administrative proceedings.
• Supervise, train and evaluate assigned staff attorneys and support staff.

Chief Assistant City Attorney

The Chief Assistant City Attorney also manages the responsibilities outlined in the Assistant City Attorney and additionally handles the most complex legal issues in partnership with the City Manager and in support of the part-time elected City Attorney. The Chief Assistant City Attorney acts as a key advisor and strategic partner to the City Manager, and at times the City Council. The Chief Assistant City Attorney functions with a high level of executive level autonomy and independence.

Valley Water is the primary water resource agency for Santa Clara County, supplying wholesale water, providing flood protection, and serving as environmental steward for clean, safe creeks and healthy ecosystems. Valley Water serves approximately two million people in 15 cities: Campbell, Cupertino, Gilroy, Los Altos, Milpitas, Monte Sereno, Morgan Hill, Mt. View, Palo Alto, San Jose, Santa Clara, Saratoga and Sunnyvale, and the towns of Los Altos Hills and Los Gatos, and manages 10 dams and surface water reservoirs, three water treatment plants, a state-of-the-art water quality laboratory, 400 acres of groundwater recharge ponds, and 275 miles of streams.
 
The Assistant Water Plant Operator helps with all day-to-day plant operations, including operating and maintaining plant equipment, calibrating water quality monitoring equipment; taking and analyzing water and chemical samples; cleaning equipment and facilities; receiving bulk chemical deliveries; operating the sludge dewatering process; using the computer-based plant control, or SCADA system, completing data entry, initiating work orders, and maintaining plant operations logs and reports. Operators work a 4 to 6-month assigned rotations between day shift, night shift, and other shifts, as needed. The facility operates and is staffed continuously, which means 24 hours a day, 365 days a year. This position reports to the Water Plant Supervisor and works under direction from the Senior/Water Plant Operator.

• Regularly conduct rounds to monitor plant operations and maintain plant equipment and grounds; observe, evaluate, troubleshoot, and report condition of the facility and equipment, including pipes, pumps, valves, feeders, motors, basins, tanks, generators, analyzers, and sludge beds; take and record measurements and instrument readings, such as pressures, temperature, flow, volume, and concentrations; operate and adjust pumps and valves; calibrate and perform preventative maintenance on plant instruments; observe and report on the flow, volume, and quality of the water, including color, odor, and turbidity; and assist in maintaining grounds in a clean, orderly, and secure state. 
• Draw samples of water and other materials from the different phases of water treatment; measure and analyze the samples to determine compliance with Valley Water and regulatory standards for chlorine, ozone, phosphate, and ammonia residuals, pH, turbidity, taste, and odor. Receive and monitor deliveries of bulk chemicals and other plant supplies.
• Perform cleaning and maintenance procedures on operating equipment and facilities; including flocculators, basins, filters, sludge drying beds, washwater clarification system, and containment and delivery areas. Employees have a responsibility for safety; for following safety regulations and safety policies and procedures applicable to their work; and for carrying out those responsibilities with due diligence as a condition of employment.
• Use the plant's computer based Supervisory Control and Data Acquisition (SCADA) system to monitor plant operations; scan multiple computer monitors simultaneously; navigate a multitude of program screens to observe, track, and retrieve water, chemical, and equipment readings. Perform various administrative tasks, including data entry into spreadsheets, update standard operating procedures, initiate work orders, maintain, compile and update plant operations logs and reports.

Level II: One (1) or more years of experience performing work as a licensed operator at a water treatment plant that is rated as a T-4 or higher facility.

The Aging and Adult Services Division of San Mateo County Health is seeking a Deputy Public Guardian Conservatorship Investigator III (DPG). The position is on the Probate Conservatorship Investigation team and is the intake section of the San Mateo County Public Guardian program.

 

The team receives referrals from all sources, for individuals who are no longer able to make decisions for themselves due to a disabling condition other than mental health. The probate conservatorship investigators conduct a very involved inquiry into the individual's past and present life to prove to the court that there are no other alternatives to conservatorship that will allow the individual to continue to live independently in the community. Conservatorship is a very invasive process as it removes most of an individual's rights. Therefore, it is as a last resort that a petition for conservatorship is filed with the Superior Court.

 

The current vacancy is in the Aging and Adult Services Division located in San Mateo, but will drive to visit clients at various locations, attend meetings, and perform various duties of the position. This person will report to the Supervising Deputy Public Guardian of Aging and Adult Services.

DPG's have responsibility for managing estates and providing casework services. They administer complex property and litigation cases, prepare complex court reports and testify in Court as needed and may develop comprehensive care plans. DPG III's also provide lead direction and training to other deputies, serve as liaisons with specific County and State department and community agencies, handle those cases that present the greatest liability to the client and/or the County, and may provide 24-hour emergency response services.

What You’ll Do

The Community Services Manager is responsible for planning, directing, and supervising the leisure, cultural, and human services activities of the Division and providing highly responsible professional and technical staff assistance. Duties may include, but are not limited to the following:

• Administer federal, state and special project grants.

Under general direction, the Deputy District Attorney I/II/III performs legal work in the enforcement of laws; prosecutes criminal cases as assigned by the District Attorney; advises the general public and law enforcement officers on criminal matters; and does related work as required. The position is scheduled for forty (40) hours per week.

JOB DUTIES

• Prepare legal briefs for motions and appeals; prepares affidavits for search and arrest warrants; prepares trial briefs, checks questions of law.
• Provides legal and investigative analysis to police agencies; prepares briefs or opinions concerning law as applied to the jurisdiction of the District Attorney.
• Anticipates legal reasoning of defense attorneys and drafts jury instructions; presents opening statements, interrogates, and cross examines witnesses, argues points of law and makes final arguments or summations.
• Issues subpoenas; attends court pretrial conferences outside of court; represents the court in criminal calendar proceedings, including the scheduling of cases, pleas, negotiations, probation revocation hearings, motions, and sentencings.

Summary:
Under general supervision, monitors and maintains the District’s central reservation system and main­tains schedules for outdoor facilities including fields, parks and picnic areas; and performs other related duties as assigned.

Essential Duties and Responsibilities:

• Maintains reservation system for the District comprising of outdoor and indoor spaces; manages mobile staging and equipment to include establishing reservation reschedules, posting schedules online, and providing direct oversight of outdoor space usage.
• Responds to online, telephone and in-person inquiries from the public and co-workers, receives web and paper reservation applications, reviews applications for proper use of space according to District guidelines, determines approval/rejection of applications, notifies applicants of decisions, and files documents for recordkeeping.
• Assists in authorizing permits for private and public entities, reviews permit holder’s evidence of insurance, submits and files insurance forms.
• Accepts payments from permit holders including deposits for space, processes payments for accounting purposes, obtains information on after-use condition of facilities, determines amount of refunds, providing justification as needed if part or all of refund is withheld, and processes deposit refunds as appropriate.
• Accurately processes monetary transactions including credit card transactions, issues receipts, reconciles cash and receipts, and prepares bank deposits.
• Researches, studies and interprets city and District rules and regulations related to use of public facilities, provides expert knowledge of space availability, codes and ordinances to the public on use of facilities.
• Assists with troubleshooting issues related to functionality of reservation software program, receives feedback on reservation system, and proposes modifications to program to enhance user experience.
• Distributes printed and posted material related to reservations in marketing efforts.

Other Duties and Responsibilities:

• May drive a District or personal vehicle.
• Participates during disasters or when emergency response is needed.
• Non-exempt employees may be required to work overtime.
• Performs other related duties as assigned.

Qualifications:
To perform this job successfully, an individual must be able to perform each essential duty satis­factorily.

Education/Experience: A typical way to obtain the knowledge and abilities would be: an associate degree from a two-year college and one year of increasingly responsible clerical experience with frequent public contact; or an equivalent combination of education and experience.

Language Ability: Ability to read, interpret and relay information obtained from documents such as ordinances relating to public use of facilities, understand operating instructions in spoken and written formats, and execute protocols and apply standard procedures per manuals. Ability to communicate effectively in written and oral forms. Ability to write routine reports and interact with the public in a positive manner. Ability to speak Spanish is desirable

Math Ability:Ability to use basic math to perform tasks such as addition, subtraction, multiplication and division in all units of measure, using whole numbers and common fractions and decimals, and prepare bank forms.

Reasoning Ability: Ability to exercise common-sense understanding to carry out instructions provided in written or oral form. Ability to synthesize necessary information related to encounters with the public and District customers in the course of work. 

Other Required Skills: Proficient use of Microsoft Office Suite including Word and Excel, type on a standard keyboard, navigate various office computer applications, operate a calculator, fax machine and other office equipment.

Certificates and Licenses:

• First Aid & CPR/AED within 90 days of employment with ability to maintain certifications thereafter as a condition of employment.
• Valid California driver’s license with a good driving record and current automobile insurance.
• All full-time candidates require satisfactory completion of a pre-employment functional capacity examination.
• Department of Justice fingerprint clearance.
• Proof of negative TB skin test.

Supervisory Responsibilities: The position has no supervisory responsibilities. This position may direct the activities of contract workers during peak periods and volunteer staff.
