Description

The Bay Area Air Quality Management District is recruiting for the position of Assistant Counsel I/II in the Office of General Counsel. This position will focus primarily on civil prosecution of air quality violations, including cases seeking civil penalties and/or injunctive relief before the Air District’s administrative Hearing Board and in Superior Court. Experience prosecuting or defending such cases under air quality or other environmental laws, or in other similar enforcement contexts, is highly desirable. The position will also provide legal advice, counseling and representation on related legal issues arising under local, state and federal air pollution laws and regulations, including air quality permitting, development of new regulations, California Environmental Quality Act issues, contract drafting, administrative law issues, and civil rights compliance, among others. Many of the most pressing air quality issues the Bay Area faces relate to disproportionate air pollution burdens in historically disadvantaged communities, so experience and familiarity with environmental justice issues is desirable. This is a full-time, exempt, management position. There is currently one (1) vacancy.
 
About the Bay Area Air Quality Management District:

The Bay Area Air Quality Management District is the government agency responsible for protecting air quality in the San Francisco Bay Area. The Air District is tasked with regulating stationary sources of air pollution in the nine counties that surround San Francisco Bay: Alameda, Contra Costa, Marin, Napa, San Francisco, San Mateo, Santa Clara, southwestern Solano, and southern Sonoma counties. It is governed by a 24-member Board of Directors composed of locally elected officials from each of the nine counties. About the Position:
 
Under direction, the position performs legal work of a routine to complex nature representing the Air District, provides advice and counsel to Air District management and staff, represents the Air District in court and administrative proceedings, and performs related work as assigned.
 
Distinguishing Characteristics:
 
Assistant Counsel I is the entry level in this specialized attorney series. It is designed to allow an experienced civil attorney to gain specific environmental law experience. This class is alternately staffed with Assistant Counsel II, and incumbents may advance to the higher level after gaining experience and demonstrating proficiency that meet the qualifications of the higher level class.
 
Assistant Counsel II is the journey level class of this specialized series, fully competent to perform a wide range of environmental law work. This class is responsible for providing effective legal counsel in complex and controversial environmental law matters. This class is distinguished from Senior Assistant Counsel in that the latter assists in administering and coordinating all phases of legal work for the Legal Division.

Examples of Duties for this Position

Prepares and tries routine to difficult cases, often involving a specialized body of law.

Represents the Air District in court and in administrative hearings before boards and commissions and state and federal agencies.

Investigates and prepares reports regarding claims by and against the Air District and recommends actions to be taken.

Advises Air District departmental management regarding Air District authority, jurisdiction, functions and operational procedures.

Researches legal problems and prepares opinions, briefs, ordinances, resolutions, and other legal documents.

Attends Air District departmental, board and commission meetings to provide legal advice on a variety of matters.

Reviews ordinances, resolutions, contracts and other documents for legal sufficiency; recommends modifications as required.

Maintains accurate records and files and compiles reports of work performed.

Monitors legal developments, including proposed legislation and court decisions; evaluates their impact on Air District operations and recommends appropriate action.

Minimum Qualifications

Education and Experience:
 
Assistant Counsel I: Equivalent to graduation from a college or university plus an appropriate law degree and two years of experience as an attorney engaged in the practice of law, preferably with a public agency and preferably involving environmental law and/or enforcement cases, although other relevant experience will be considered.
 
Assistant Counsel II: In addition to the above, two additional years of experience as an attorney engaged in the practice of law, preferably practicing civil environmental enforcement with a public agency in the State of California, although other relevant experience will be considered.
 
 Other Requirements:
 
 Must be a member in good standing of the State Bar of California at the time of hire.

THE POSITION:  The City of San Mateo’s Community Development Department has an opportunity for an intern to work on a number of projects. The Management Analyst Intern will primarily support the Housing and Business/Admin Divisions and receive primary supervision from the Department’s Business Manager and Housing Manager, and project specific direction from the supervisor/manager primarily responsible for each specific project. DUTIES: The primary projects will most likely include the following: 
•    Market Research / Data Analysis. Support the research and help prepare findings report on fee schedules across multiple jurisdictions to help the Business Manager prepare for the 2025 comprehensive fee study. 
•    Contracts / Grant Administration. Support the Housing Division Community Development Block Grant (CDBG) and Permanent Local Housing Allocation (PLHA) administration of contracts and grant funds for nonprofit recipients.
•    Housing Element Compliance / Certification. Support the Housing Division with implementation of Housing Element policies and programs.
•    Community Relations Commission Support. Support the Community Relations Commission, under the direction of the commission liaison, in coordinating commission meeting, preparing documents for commission review, and preparing commission documents for approval and filing with the City Clerk.

In addition, the intern may work on a variety of other projects to support Community Development Department special projects and operations, depending upon need, availability and interest.

DEFINITION:

Under general direction, manages and directs the Accounting Division of the Finance Department, including the budget development process and preparation of the budget book; budget monitoring, analysis and reporting; short- and long-range fiscal forecasting; ensuring adherence to financial policies and procedures; and capital planning.  The Accounting Manager trains and evaluates assigned staff.

CLASS CHARACTERISITICS:

This is a single position classification at the managerial level in the Finance Department responsible for managing the budget and accounting functions. The Accounting Manager has a broad range of independence within policy and procedural limitations and works under minimal supervision. The incumbent is accountable to the Finance Director for the quality and efficiency of services directed.  The Accounting Manager is expected to provide resources, system support, and oversight to all subordinate professional and paraprofessional staff. This position is responsible for the successful planning and implementation of the citywide budget process and the day-to-day accounting operations.  

EXAMPLES OF DUTIES (illustrative only):

• Plan, organize, direct and evaluate the activities of the Accounting Division including general accounting, accounts payable and payroll.
• Recommend the appointment of personnel; provide or coordinate staff training; conduct performance evaluations; work with employees on performance issues; and implement disciplinary procedures.
• Prepare, review and maintain journal entries and general ledger postings and supporting financial records and supervise the maintenance of the General Ledger.           

• Conduct and coordinate the annual audit and serve as the liaison between the City and the external auditors, provide requested information and necessary documentation for completion of the audit, and ensure timely completion of the audit, State Controller’s Office reports and other compliance reports as required.
• Oversee reconciliations of the City’s financial activities including bank accounts and investments, month-end and year-end close processes and prepare related reports.
• Plan and implement citywide budget process and related fiscal programs.
• Effectively communicate budget preparation calendar and information needs, capabilities, and limitations as well as budget policies, procedures and outcomes to departments, city officials, citizens, and other interested parties.
• Project citywide personnel costs on an annual basis and as needed.
• Monitor the City’s budget, perform budget analysis, prepare quarterly budget status reports, develop financial and capital plans, and prepare short- and long-range financial forecasts.
• Research and implement new budget initiatives that increase the usefulness and clarity of budget presentations and maximize staff efficiency.
• Conduct a variety of special studies; prepare and present various analyses, statistical compilations, and reports to City staff, City Council, or the public.
• Assist in the management of the City’s capital financing programs, including debt issuance.
• Facilitate development and implementation of improved processes and standard procedures.

• Assist in operational administration of risk management activities as assigned.

DEFINITION

Under the general direction of the Director of Finance and Administrative Services, the Assistant Director serves as part of the management team of this municipal department and assists with planning, directing, coordinating and administering the functions of accounting, budgeting, and a wide range of support services including business licensing, payroll, utility billing, information technology and other functional areas of the Finance Department.

EXAMPLES OF DUTIES

Responsibilities may involve direct or indirect supervision of any or all of the above functions with primary emphasis on accounting, budgeting, financial analysis, payroll, and information technology. 

The Assistant Director plays a critical role in the management of accounting functions and preparation of the Comprehensive Annual Financial Report; development of City operating and capital budgets including preparing complex financial analyses, working with contract financial consultants and actuaries, developing payroll projections and providing support to labor negotiations, developing strategies to improve workflow and service delivery, and overseeing the internal service fund financial management and cost allocation.

The Assistant Director also plays a key role in evaluation of the City’s Enterprise Resource Planning (ERP) software system, including evaluation of the current and any future system, working with Finance staff in accounting, payroll, and information technology as well as Human Resources staff to ensure efficient implementation of all aspects of the system.

In addition, the Assistant Director prepares complex reports and presentations before the City Council and the public, represents the department in various meetings, resolves difficult and sensitive citizen inquiries and complaints, and serves as acting Director in the absence of the Director of Finance and Administrative Services.

MINIMUM QUALIFICATIONS

Knowledge of:   Current principles, practices and techniques of organization, administration, supervision, training, personnel management; principles of accounting and finance, including Generally Accepted Accounting Principles, governmental accounting, auditing, budgeting, financial management, revenue forecasting, risk management, automated financial information systems; and advanced applications of modern office software including Microsoft Excel, Word and PowerPoint.

Ability to:  Prepare timely and accurate accounting and financial reports; analyze accounting systems and internal control procedures; recommend and implement changes for improvement; prepare computer spreadsheets, narrative reports and presentations; effectively supervise, train and coordinate the work of subordinate personnel; set goals and objectives for the work unit and ensure that they are carried out; develop performance criteria for the work unit and use the information collected to improve efficiency and effectiveness; interact positively with co-workers; deal tactfully, effectively and cooperatively with the public, elected officials and City employees; work independently and exercise sound judgment; interpret rules, policies and procedures; analyze problems, identify alternative solutions and implement recommendations in support of organizational goals; and communicate clearly and concisely both orally and in writing.

Experience:  Six years of increasingly responsible experience in accounting, budgeting and management experience in a public agency, including four years in a supervisory capacity.

Education:  Graduation from an accredited college or university with major coursework in Accounting, Finance, Public Administration or related fields. Additional certifications (e.g. Certified Public Accountant (CPA) or advanced degrees) are desirable.

License:  Possession of a valid Class C California Driver's License.
