THE POSITION

The City Attorney's Office seeks a well-qualified, motivated attorney for the position of Assistant City Attorney. This is an at-will position that serves as part of the City's executive management team. 

The Assistant City Attorney will provide legal advice, counsel, and representation to the City in areas including, but not limited to, land use, real estate, housing, and environmental law. Duties include drafting and reviewing contracts, ordinances, resolutions, deeds, permits, licenses, and other legal documents, conducting research, interpreting and updating the City Municipal Code, and providing advice to City staff. 

The Assistant City Attorney will provide counsel to the Planning Commission, the Community Development Department, other City departments, and assist with the enforcement of City Municipal Code. The Assistant City Attorney receives general direction and supervision from the City Attorney and may provide oversight and supervision to support staff. THE IDEAL CANDIDATE

The ideal candidate will have a broad base of knowledge and experience in a variety of areas of municipal law such as the Brown Act, Political Reform Act, Public Records Act, contracts, personnel matters, public safety, public works, and advisory and litigation services. Extensive expertise in land use, Planning and Zoning, the Subdivision Map Act, CEQA, and Housing is especially desirable. However, applicants without land use expertise are also encouraged to apply.

THE DEPARTMENT

The City Attorney's Office also prepares and/or reviews all ordinances, resolutions. contracts and other documents and represents the City in civil litigation and acts as liaison to outside special counsel.

MINIMUM QUALIFICATIONS

Graduation from a law school accredited by the American Bar Association with a Juris Doctorate degree;

Description

The Bay Area Air Quality Management District is recruiting for the position of Assistant Counsel I/II in the Office of General Counsel. This position will focus primarily on civil prosecution of air quality violations, including cases seeking civil penalties and/or injunctive relief before the Air District’s administrative Hearing Board and in Superior Court. Experience prosecuting or defending such cases under air quality or other environmental laws, or in other similar enforcement contexts, is highly desirable. The position will also provide legal advice, counseling and representation on related legal issues arising under local, state and federal air pollution laws and regulations, including air quality permitting, development of new regulations, California Environmental Quality Act issues, contract drafting, administrative law issues, and civil rights compliance, among others. Many of the most pressing air quality issues the Bay Area faces relate to disproportionate air pollution burdens in historically disadvantaged communities, so experience and familiarity with environmental justice issues is desirable. This is a full-time, exempt, management position. The Bay Area Air Quality Management District is the government agency responsible for protecting air quality in the San Francisco Bay Area. The Air District is tasked with regulating stationary sources of air pollution in the nine counties that surround San Francisco Bay: Alameda, Contra Costa, Marin, Napa, San Francisco, San Mateo, Santa Clara, southwestern Solano, and southern Sonoma counties. About the Position:
 
Under direction, the position performs legal work of a routine to complex nature representing the Air District, provides advice and counsel to Air District management and staff, represents the Air District in court and administrative proceedings, and performs related work as assigned.
 
Distinguishing Characteristics:
 
Assistant Counsel I is the entry level in this specialized attorney series. It is designed to allow an experienced civil attorney to gain specific environmental law experience. This class is alternately staffed with Assistant Counsel II, and incumbents may advance to the higher level after gaining experience and demonstrating proficiency that meet the qualifications of the higher level class.
 
Assistant Counsel II is the journey level class of this specialized series, fully competent to perform a wide range of environmental law work. This class is responsible for providing effective legal counsel in complex and controversial environmental law matters. This class is distinguished from Senior Assistant Counsel in that the latter assists in administering and coordinating all phases of legal work for the Legal Division.

Examples of Duties for this Position

Prepares and tries routine to difficult cases, often involving a specialized body of law.

Represents the Air District in court and in administrative hearings before boards and commissions and state and federal agencies.

Investigates and prepares reports regarding claims by and against the Air District and recommends actions to be taken.

Advises Air District departmental management regarding Air District authority, jurisdiction, functions and operational procedures.

Researches legal problems and prepares opinions, briefs, ordinances, resolutions, and other legal documents.

Attends Air District departmental, board and commission meetings to provide legal advice on a variety of matters.

Reviews ordinances, resolutions, contracts and other documents for legal sufficiency; recommends modifications as required.

Maintains accurate records and files and compiles reports of work performed.

Monitors legal developments, including proposed legislation and court decisions; evaluates their impact on Air District operations and recommends appropriate action.

Minimum Qualifications

Education and Experience:
 
Assistant Counsel I: Equivalent to graduation from a college or university plus an appropriate law degree and two years of experience as an attorney engaged in the practice of law, preferably with a public agency and preferably involving environmental law and/or enforcement cases, although other relevant experience will be considered.
 
Assistant Counsel II: In addition to the above, two additional years of experience as an attorney engaged in the practice of law, preferably practicing civil environmental enforcement with a public agency in the State of California, although other relevant experience will be considered.
 
 Other Requirements:
 
 Must be a member in good standing of the State Bar of California at the time of hire.

Under general supervision, the incumbent learns to, and performs the full array of duties assigned to classes in the Maintenance Worker series including maintenance, construction and equipment operation work and performs other related duties as required.

DISTINGUISHING CHARACTERISTICS

The Maintenance Worker I is the entry level class responsible for a wide variety of maintenance and construction tasks.

SUPERVISION RECEIVED/EXERCISED

The Maintenance Worker I receives general supervision from a Public Works Supervisor or designee. Incumbents of this class do not routinely exercise supervision.

The position also requires both near and far vision when inspecting work and operating assigned equipment. The need to lift, carry and push tools, equipment and supplies weighing 25 pounds or more is also required. Additionally, the incumbent in this outdoor position works in all weather conditions including wet, hot and cold. The incumbent may use cleaning and lubricating chemicals, pesticides or herbicides which may expose the employee to fumes, dust and air contaminants. The nature of the work also requires the incumbent to climb ladders, use power and noise producing tools and equipment, operate hydraulic aerial devices, drive motorized vehicles and heavy equipment, work in heavy vehicle traffic conditions and often work with constant interruptions.

The Wastewater Treatment Plant (WWTP) is a 15.7 MDG sub-regional facility that serves an estimated 164,545 customers  administering the annual operation and maintenance budget over $12.8 million with a staff of 34 professional and technical personnel.  The City of San Mateo is building a team tasked with the safe and continuous operation of the current expansion of this conventional activated sludge plant by introducing new facilities including; preliminary treatment, primary treatment, enhanced biological nutrient removal/membrane bioreactors (BNR/MBR), biological and chemically enhanced treatment (BioACTIFLO), and additional upgrades to existing process equipment. A vital and instrumental member of this team is the WWTP Operator III.

The Position

This position will receive general direction from the Chief Plant Operator and instruction from their Shift Supervisor to provide daily guidance to lower level operators and trainees. The WWTP Operator III will be responsible for supporting these efforts to guide, develop and mentor staff on their assigned shift, act in a supervisory capacity in the absence of the Shift Supervisor, and is the assigned lead in getting both scheduled and unscheduled work completed. Those who have prepared themselves and are ready for the challenge to use their skills as a journey-level wastewater professional should seriously consider this opportunity.

This position is assigned rotating shifts working nights, weekends, and holidays with on-call emergency response 24 hours per day.  However, along with this challenge is the benefit of working  a 12-hour shift that results in a very favorable work/life balance and requires the minimum commuting days as compared to other standard 8-hour shifts.

The Duties

Depending upon assignment, duties may include, but are not limited to the following.

Operate wastewater treatment facilities to control flow and processing of wastewater, sludge and effluent; monitor gauges, meters and control panels; observe variation in operating conditions, interpreting meter and gauge readings and test results to determine process requirements.

• Operate valves and gates; start and stop pumps, engines and electric motors to control and adjust flow and treatment processes; operate and maintain boilers; perform routine maintenance work on valves, tanks, related equipment and facilities to optimize performance.
• Maintain appropriate plant records to support water quality goals.
• Perform the duties of the Designated Operator-in-Charge when required in accordance with State regulations.
• Operate rolling vehicles and stationary machinery as required to perform essential job functions.
• Foster and maintain good working relationships and provide excellent customer service in the course of their work.
• Assist in the inventory, requisition, and purchase of supplies and materials.
• Supervise and train less experienced operators on assigned shift.
