THE POSITION:
This position may be filled at either the Assistant City Attorney or Deputy City Attorney II level depending upon the qualifications and experience of the candidate selected. The principal distinction between the levels is the significance and complexity of the assignments given and the amount of supervision provided. Under general supervision of the City Attorney, this position researches legal issues; prepares legal opinions; advises department officials on legal questions involving City operations; try lawsuits in court, arbitrations, and other administrative hearings; prepares appellate and trial briefs, pleadings, ordinances, resolutions, contracts, leases, and other legal documents; and performs selected administrative duties. Assignments involving land use law, real estate transactions, labor relations and personnel, rent control, municipal finance, and police activities are possible.
In addition to the general qualifications listed above and on the job descriptions, the ideal candidate will have at least three years of concentrated experience in labor and employment law in the public sector, including trial practice in court or PERB, arbitrations, contract negotiations, progressive discipline, internal investigations, administrative hearings, FMLA and similar leave policies. The ideal candidate works well with others and excels in building internal relationships and has experience working with sworn personnel.
DEFINITION
To provide a wide range of professional legal services to all City departments, the City Council and various boards and commissions.
Duties may include, but are not limited to, the following:
ASSISTANT CITY ATTORNEY
Perform legal research and prepare written and oral opinions on various legal problems for City departments, the City Council, and various boards and commissions.
Confer with and render assistance to department directors in establishing departmental policies by applying legal points and procedures; recommend changes in policies and procedures in order to meet legal requirements.
Prepare, draft and review ordinances, resolutions, contracts, deeds, leases and other legal documents and instruments, and offer opinions as to legal acceptability when presented to the City for consideration by an outside agent or agency.
Prepare cases for court and jury trials and serve as lead trial attorney.
DEPUTY CITY ATTORNEY II
Perform legal research and prepare opinions on various legal problems for City departments, the City Council, and various boards and commissions.
Prepare and draft ordinances, resolutions, contracts, deeds, leases and other legal documents and instruments; review such documents and offer opinions as to legal acceptability when presented to the City for consideration by an outside agency.
Represent the City in civil actions brought by or against the City.
Investigate claims and complaints by or against the City and recommend action to be taken.
JOB RELATED AND ESSENTIAL QUALIFICATIONS
ASSISTANT CITY ATTORNEY
Knowledge of:
- Legal principles and practices, including civil, criminal, constitutional, and administrative law and procedure.
- Methods of legal research.Judicial procedures and rules of evidence in state and federal courts.
- Ordinances, statutes and court decisions relating to municipal corporations.
- Organization and operating procedures of a City Attorney's office.
Ability to:
- Analyze a wide variety of legal issues.
- Conduct research on legal problems and prepare sound legal opinions.
- Communicate clearly and concisely, orally and in writing.
- Analyze or prepare a wide variety of legal documents.
- Prepare and present cases. Perform legal work requiring the use of independent judgment.
DEPUTY CITY ATTORNEY II
Knowledge of:
· Real estate, zoning and labor law and procedures.
· Ordinances, statutes, and court decisions relating to municipal corporations.
· Organization and operating procedures of a City Attorney's office.
· Legal principles and practices, including civil, criminal, and administrative law and procedures.
· Litigation experience.
Ability to:
Perform legal work involving the use of independent judgement.
EXPERIENCE AND EDUCATION
Any combination equivalent to experience and education that could likely provide the required knowledge and abilities would be qualifying. A typical way to obtain the knowledge and abilities would be:
ASSISTANT CITY ATTORNEY
Experience: Five (5) years of experience performing duties comparable to those of an Attorney for the City of Hayward.
Education: Possess a Juris Doctor Degree from an accredited law school
Licenses and Certificates: Possess and maintain a valid California Driver's License. Membership in the State Bar of California.
DEPUTY CITY ATTORNEY II
Experience: Two (2) years of experience performing duties comparable to those of a Deputy City Attorney I for the City of Hayward.
Education: Possess a Juris Doctor Degree from an accredited law school
Licenses and Certificates: Possess and maintain a valid California Driver's License. Membership in the State Bar of California.

Candidates must submit a completed City of Hayward job application and responses to the Supplemental Questionnaire which fully describe the nature of their professional experience and qualifications. Applications submitted without all required materials will not be considered.
Based on the information provided, employment applications will be reviewed for minimum qualifications. Those best qualified may be invited to the next phase of the process, which may include an oral, practical, written examination and/or supplemental questionnaires reviewed by subject matter experts.
The examination process will result in a ranked eligible register of candidates for hiring consideration by the department derived from any of the exam processes mentioned above. Actual hire depends on success in the departmental selection process.
Candidates under final consideration for employment with the City should expect to undergo an employment background/reference check that may include, but is not limited to: employment history, medical evaluation, confirmation of educational credentials and degrees, licenses including driver's license, registrations, certificates, and other credentials as part of the appointment process. Some positions, depending on the nature of the work, also require a credit check and a review of Summary Criminal History obtained from the State Department of Justice through Live Scan Fingerprinting.
